Friels are committed to ensuring that your privacy is protected and respected. This privacy policy sets out why and how we use and protect any personal information that you give us, and how to exercise your privacy rights and choices.

Please read the following to understand our views and practices regarding your personal data. We may change this policy and will update it on this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from 25/05/18.

Your Personal Information

The way we collect, handle and use your personal information depends on your relationship with Friels. Please see below the six types of personal information we may collect from you to see which category is applicable to you:

1. Interested Parties – those who have expressed an interest in receiving our Newsletters, Sales Literature or progress updates on one or all of our new property developments. These can be potential purchasers or various stakeholders, such as neighbours, who would like to know more about the development

2. Our Freehold Purchasers – those who are in the process of, or who have already purchased a freehold property from us

3. Our Leasehold Purchasers – those who are in the process of, or who have already purchased a leasehold property from us e.g. an apartment

4. Our Tenants – those who have an Assured Short Hold Tenancy Agreement (AST) with us

5. Our Clients Customers – those who have purchased a property from one of our clients whose data we may be given if an appointment is required for maintenance work to their property

6. Our Sub-Contractors – those who are currently sub-contracting for us, have done so in the past or have provided their details to be considered for sub-contractor work in the future.


1. Interested Parties

Why we collect your data

Your data is collected solely for us to be able to contact you with updates on the development(s) you have expressed an interest in. This may include Newsletters, Sales Literature or general progress updates.

How we collect your data

We collect your data through webforms on our website, email enquiries, over the phone and by our on-site sales staff. You will always be given the opportunity to opt-out of communications at any time by either emailing info@friels.co.uk or calling our office on 01922 708860.

What we collect

We may collect the following information from you:
• name
• contact information including email address, telephone number and address
• which development you have an interest in
• any additional information you may provide in your enquiry message to us. For example, information on what your interest in our development is, e.g. “potential purchaser” or “neighbour”, or which elements of the development you are interested in, e.g. “require minimum 3 bedrooms” or “ground floor apartment only”. We may use this information to determine which of our sales literature is appropriate to your interests.

What we do with the information we gather

• Once you have expressed an interest in our development(s) we will ask for written consent from you, via email or post, to confirm you would like to sign up to our Newsletters, Sales Literature or general progress updates.
• Your information will be stored on a secure computer database and used to contact you with relevant Newsletters, Sales Literature or general progress updates.
• We will store this information for up to 2 years or until the development is complete, which ever comes first. If there are still properties available on the development after 2 years, we will contact you for written consent that you wish to stay on the database. If we do not receive a response within 2 weeks, your details will then be deleted.
• You can ask us at any time for a copy of the details we hold on you or to have your details removed from the database by either emailing info@friels.co.uk or calling our office on 01922 708860.

When we would share your data

Friels can assure you that we will not sell your data to any third parties.
Data collected on parties interested in any of our developments will not be shared with any third parties unless we have your permission or are required by law to do so.

2. Our Freehold Purchasers

Why we collect your data

We collect your data to be used in legal documents relating to the sale of your property, to allow us to contact you throughout the sale process and for ongoing maintenance once you have moved in.

How we collect your data

We collect your data through webforms on our website, email enquiries, over the phone, by our on-site staff and within reservation or sales documentation.

What we collect

We will collect information from you as required for contact and to proceed with the legal documents of your sale. This may include the following, please note this list is not exhaustive and additional information may be required for legal reasons:
• name
• contact information including email address, telephone number and address
• purchasers position relating to the sale e.g. property to sell, cash buyer

What we do with the information we gather

• Once you have reserved a property with us we will add your personal information to our customer database.
• Your contact information will be kept on a secure computer database to be used by our sales and customer service staff members when they need to contact you regarding your sale or maintenance once you have moved in.
• If you do not proceed with the property purchase, we may keep your details on record for 12 months and they will then be deleted.
• If you do proceed with the purchase, we will keep your details for up to 10 years in order to carry out our obligations arising from the contract entered into between us. This timescale is in line with the 10-year NHBC Warranties we have on most of our developments. Alternatively, we will remove your details if we are notified that you have sold the property, whichever comes first.

When we would share your data

Friels can assure you that we will not sell your data to any third parties.
If you are an existing customer who is in the process of purchasing or have already purchased one of our properties we may need to pass on your details to third parties such as solicitors, suppliers or sub-contractors as part of the sale process or for maintenance work. For example, we may provide the details in your reservation or offer form to our solicitor to issue draft documentation or your telephone number to a plumbing contractor to arrange an appointment with you directly. We will agree this with you in advance and ensure we have your consent before passing on your details. We ask our suppliers and sub-contractors to delete your contact details once the job is complete.
Your personal information will not be shared with any third parties unless we have your permission to do so or are required by law to do so.


3. Our Leasehold Purchasers

Why we collect your data

We collect your data to be used in legal documents relating to the sale of your property, to allow us to contact you throughout the sale process and for maintenance once you have moved in.

How we collect your data

We collect your data through webforms on our website, email enquiries, over the phone, by our on-site staff and within reservation or sales documentation.

What we collect

We will collect information from you as required for contact and to proceed with the legal documents of your sale. This may include the following, please note this list is not exhaustive and additional information may be required for legal reasons:
• name
• contact information including email address, telephone number and address
• purchasers position relating to the sale e.g. property to sell, cash buyer

What we do with the information we gather

If you are an existing customer who is in the process of purchasing or have already purchased one of our properties we may need to pass on your details to third parties such as solicitors, managing agents, suppliers or sub-contractors as part of the sale process or for maintenance work. We will agree this with you in advance and ensure we have your consent before passing on your details. We ask our suppliers and sub-contractors to delete your contact details once the job is complete.

4. Our Tenants

Why we collect your data

We collect your data to be used in legal documents relating to your AST, to allow us to contact you throughout the process and for maintenance once you have moved in.

How we collect your data

We collect your data through webforms on our website, email enquiries, over the phone, by our on-site staff, within application or AST documentation and via our managing agents.

What we collect

We will collect information from you as required for contact and to proceed with the legal documents of your AST. This may include the following, please note this list is not exhaustive and additional information may be required for legal reasons:
• name
• contact information including email address, telephone number and address
• position relating to the lease, e.g. able to move in immediately

What we do with the information we gather

• Once you have signed a AST with us we will add your personal information to our customer database.
• Your contact information will be kept on a secure computer database to be used by our sales and customer service staff members when they need to contact you regarding your AST or maintenance of the property.
• If you rent a property from us your data will be retained by us, unless you request deletion, for the duration of your tenancy.

When we would share your data

Friels can assure you that we will not sell your data to any third parties.
If you are an existing customer who is in the process of renting or have rented one of our properties we may need to pass on your details to third parties such as solicitors, managing agents, suppliers or sub-contractors as part of the sale/rental process or for maintenance work. For example, we may provide the details in your application form to our solicitor to issue draft documentation or your telephone number to a plumbing contractor to arrange an appointment with you directly. We will agree this with you in advance and ensure we have your consent before passing on your details. We ask our suppliers and sub-contractors to delete your contact details once the job is complete.
Your personal information will not be shared with any third parties unless we have your permission to do so or are required by law to do so.


5. Our Client’s Customers

Why we collect your data

Your data is provided to us by our Client, from whom you have purchased a property, in order to contact you where maintenance work may be required. We will use the contact information provided to get in touch and arrange an appointment time with you and to provide updates on work where required.

How we collect your data

Our Client, from whom you have purchased a property, will provide your contact details to us via email. This will then be emailed directly to the relevant member of our customer care team or site supervisor who will contact you directly regarding the maintenance issue.

What we collect

We may collect the following information from you:
• name
• contact information including email address, telephone number and address
• information on the specific maintenance issue at hand

What we do with the information we gather

• Your information will be stored on a secure computer database and used to contact you until the maintenance problem is resolved.
• Once the problem has been resolved the data will be anonymised with all personal details apart from address removed from our database. The address and details of work carried out will be kept on our database for up to 10 years (in line with NHBC Warranties usually in place on our Client’s properties) to ensure we keep a record for future reference. 
• Our Customer Care Team and Site Supervisor will permanently delete all emails containing your personal details once work is complete and the issue resolved.
• You can ask us at any time for a copy of the details we hold on you or to have your details removed from the database by either emailing info@friels.co.uk or calling our office on 01922 708860.

When we would share your data

Friels can assure you that we will not sell your data to any third parties.
Data collected on our Client’s Customers will not be shared with any third parties unless we have your permission or are required by law to do so.


6. Our Sub-Contractors

Why we collect your data

Your data is provided to us by you to allow us to contact you, to verify your CIS status with HMRC and to make payments to you.

How we collect your data

We will usually collect your data from you via email enquiry, over the phone, or in person.

What we collect

We may collect the following information from you:
• Name
• Contact information including email address, telephone number and address
• Relevant qualifications
• Previous experience
• Bank and CIS details once engaged as a sub-contractor

What we do with the information we gather

• Your information will be stored on a secure computer database and used to contact you.
• You can ask us at any time for a copy of the details we hold on you or to have your details removed from the database by either emailing info@friels.co.uk or calling our office on 01922 708860.
• Your details will be deleted from our database 6 months following your initial enquiry unless we have engaged you for work, in which case you will remain on our system.

When we would share your data

Friels can assure you that we will not sell your data to any third parties.
If we have engaged you for work, your name, work email address and work telephone number may be shared with purchasers and tenants where it is appropriate to do so, for example, to arrange an appointment to carry out work.
Data collected on our Sub-Contractors will not be shared with any other third parties unless we have your permission or are required by law to do so.

Security

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect.
Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted online or through the website. Any transmission is at your own risk. Once we have received your information, we use strict procedures and security features to try to prevent unauthorised access.


Controlling your personal information

You have certain rights in relation to your information including a right to access or to correct the information we hold on you. We have listed the rights you have over your information and how you can use them below.

These rights will only apply in certain circumstances. They will generally not be applicable if there are outstanding contracts between us, if we required by law to keep the information or if the information is relevant to a legal dispute.
